This Criminal Original Petition has been filed seeking for quashing the proceedings in D.V.C.No.4 of 2015 on the file of the learned Judicial Magistrate Court No.II, Namakkal & District against the petitioners for the offence under Section 12 of the Domestic Violence Act.
2. Mr.R. Sathish Kumar, learned legal aid Counsel appearing for the respondent, on instructions, submitted that there was some matrimonial dispute arose between the first petitioner and the respondent/wife.
Subsequently, the respondent/wife filed the petition in H.M.O.P.No.462 of 2014 on https://hcservices.ecourts.gov.in/hcservices/
the file of the Family Court, Erode for seeking divorce and the same was dismissed as withdrawn by the Court below on 06.08.2016 and hence, nothing survives for further adjudication in this petition.
3. Recording the above submission made by the learned Counsel for the respondent, the Criminal Original Petition is nothing survives for further adjudication in this petition and hence, this Criminal Original Petition is closed.
