C.M.P.No.967 of 2021 in A.S.Sr.No.1914 of 2021 DR.G.JAYACHANDRAN,J., This petition is filed to condone the delay of 29 days in filing the appeal suit.

2. In the affidavit filed in support of the petition it has been stated that due to over sight, copy application was not filed immediately after the judgment passed by the trial Court on 26.11.2019. The parties were under the impression that the copy application was filed by the advocate clerk, but they came to know that the clerk who was not well and recovered from his illness, thereby copy application was not filed by him.

3. Since in view of the pandemic situation, the appellant was not able to file appeal suit, this Court finds taking reason to the delay. Hence the delay of 29 days in filing the appeal suit is condoned and the petition is ordered accordingly.

4. The Registry is directed to number the appeal, if it is in order.
