ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for alleged offences punishable under Sections 303(2) and 326(a) of BNS in Crime No.152 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have transported three units of river sand in his lorry bearing Reg.No.KA-52-B-8432 without permit. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not been been involved in the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate appearing for the respondent submitted that this Court already dismissed the petitioner's anticipatory bail petition in Crl.O.P.No.25147 of 2025 dated 15.09.2025, and there is no change in circumstances. Hence, she vehemently opposed to grant anticipatory bail to the petitioner.

5. This Court had dismissed the petitioner's anticipatory bail petition on 15.09.2025 in Crl.O.P.No.25147 of 2025, however without any change in circumstances, present petition is filed. The earlier order of this Court reads as follows:

5. Considering the fact that the petitioner has illegally transported three units of river sand without permit and the complainant VAO who had gone to the spot on receiving

information of the unloading of the river sand.

6. This Court is of the view that the quantum of river sand illegally transported is high and the anticipatory bail for this crime cannot be granted.

6. In view of the above, this Court is not inclined to revisit the earlier order, since there is no change in circumstances.
