ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS Act r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, in Crime No.289 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had involved in 1/4

illegal transportation of 2 bags of river sand from Vellaru river without any valid license. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has no previous case pending against him and he is ready to abide by any condition imposed by this court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police reiterated the prosecution case and submitted that the petitioner had involved in illegal transportation of 2 bags of river sand from Vellaru river without any valid license and hence, he opposed to grant anticipatory bail to the petitioner .

Considering the nature of offence committed by this petitioner and that this petitioner had involved not only in quarrying the river sand but also in damaging the environment and ecology and if this petitioner is granted anticipatory bail, he will involve in similar activities and hence this Court is not inclined to grant anticipatory bail to this petitioner. 2/4

6. Accordingly, this Criminal Original Petition stands dismissed. 12.01.2026 To:
