Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 2nd respondent to pass orders on the appeal dated 24.05.2024, filed by the petitioner and issue separate patta to the petitioner property at Old Survey No.42/6, New Survey No.42/6B2 and New Survey No.42/6B2D, Patta No.202 at Narasampati Village, Oothangarai, Krishnagiri Distrit within a stipulated period as fixed by this Court.

O R D E R

The petitioner seeks a mandamus to the second respondent to pass orders on the representation dated 24.05.2024 given by the petitioner and to issue a separate patta in respect of the subject properties. 2.The petitioner's contention is that the subject property had been purchased by her within specified boundaries from one Sennammal under registered Sale Deed in Doc.No.3729 of 2023. From the date of purchase, she has been in possession and enjoyment of the property and has been paying necessary charges and taxes.

3. The petitioner had therefore applied for issue of separate patta through online to the 3rd respondent in A.No.2023/0105/31/527169. This application was rejected stating that there was difference in the extent of land between the Patta Transfer Application and the Sale Deed. However, a detailed order was not furnished by the third respondent. Thereafter, the petitioner sent a representation to the 3rd respondent under RTI query dated 21.02.2024. On 06.05.2024, the third respondent had furnished the details sought by the petitioner. Upon receipt of said details, the petitioner preferred an appeal petition dated 24.05.2024 to the second respondent seeking fresh survey and issuance of separate patta for the subject property. But till date, no action has been taken by the second respondent. Aggrieved 2/4

by the same, the petitioner moved this writ petition.

4. Heard the learned counsels on either side.

Taking into account the facts set out above herein and considering the fact that the appeal which has been filed in the month of May 2024 is yet to be disposed of, a mandamus is issued to the second respondent to pass orders in the appeal dated 24.05.2024 within a period of two months from the date of receipt of a copy of this order.
