O R D E R
The prayer sought for in the present petition is to direct the first respondent to provide police protection to conduct the festival of the temple namely Sri Kaliyamman Temple situated at Veppampoondi Village, Gangavalli Taluk, Salem District based on the petitioner's representation dated 15.02.2018.
2. Heard both sides.
3. The learned Government Advocate (Crl. Side), on instructions, submitted that the petitioner's request to conduct the pongal festival for the year 2018 has been rejected by the Revenue Divisional Officer, Attur in his proceeding in Na.Ka.No.588/2018/A2 dated 17.02.2018. On a perusal of the said order, it is seen that the Revenue Divisional Officer was of the https://hcservices.ecourts.gov.in/hcservices/
opinion that the petitioner herein had already filed a Civil Suit in this connection, which is said to be pending till date. Furthermore, it was observed while rejecting permission for conducting the festival, that there could be a law and order problem.
4. While that being so, it would not be appropriate to direct the first respondent to provide police protection for conducting the festival in which, it is always open to the petitioner to challenge the order of the Revenue Divisional Officer, rejecting the petitioner's request for conducting festival.
5. In view of the same, I do not find any merits in this petition. Accordingly, the Criminal Original Petition stands dismissed.
