...Respondent
Prayer: Civil Miscellaneous Appeal filed under Section 47 of the Guardians and Wards Act, to set aside the order and decreetal order dated 25.04.2006 in HMGOP No.61 of 2004 on the file of the First Additional Subordinate Judge, Coimbatore and allow the appeal.
For Appellant : M/s.AL.Ganthimathi For Respondent : Mr.S.Shrenik Raj
JUDGMENT
The Appellant is aggrieved by the decreetal order dated 25.04.2006 passed in HMGOP.No.61 of 2004 by the aforesaid fair and decreetal order. The Lower Court had dismissed the application filed by the appellant under Section 6 of the Hindu Minority and Guardianship Act of 1956 for granting the custody of minor child Akshaya to the petitioner and also to direct the respondent to put the person of the minor child Akshaya into the hands of the petitioner for custody. When the application was filed on 11.06.2004, the minor was aged about five years. Today, 15 years had lapsed. Therefore, I do not find any merits in the present case.
2.Accordingly, the present Civil Miscellaneous Appeal is dismissed as infructuous. No costs.
