Durga Devi v. Jayakumar

2022-02-17Honourable Mr Justice N. Seshasayee2 pages

Crl.M.P.No.1786 of 2022 in Crl.RC.No.649 of 2021 Crl.M.P.No.1786 of 2022 in Crl.RC.No.649 of 2021 N.SESHASAYEE, J., This matter is posted today for mentioning on a representation made by the learned counsel for the Revision Petitioner.

2.The learned counsel for the Revision Petitioner brought to the notice of the Court that Paragraph No.6 of the Order dated 17.02.2022 is inconsistent with Paragraph No5.

3.This Court perused both paragraph no.5 and Paragraph no.6. This Court has conciously decided not to revoke suspension of sentence and only directed the Revision Petitioner to stay in Nagercoil and sign before Judicial Magistrate - 1 daily at 10.30 a.m until further orders. However, Paragraph No. 6 reads that the petition for cancellation for suspension of sentence was ordered and that the bail itself was cancelled. 4.This sentence has inadvertently crept in the order and it has been overlooked by the Court.
