ORDER
This Writ Petition has been filed seeking to direct the respondents to consider the petitioner's representation dated 17.11.2025, within a time frame fixed by this Court.
2. Mr.K.Surendran, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.
3. The case of the petitioner is that the petitioner joined the Tamil Nadu Police Department as a Police Constable on 25.05.1988 and he was subsequently, promoted as Sub-Inspector of Police. While so, the third respondent issued a show cause notice vide proceedings in
Na.Ka.No.H2/Tha.Pe.No:45/2025, alleging inaction on the part of the petitioner against a case relating to sand theft. Pursuant to the said notice, the petitioner submitted his explanation. Thereafter, he was transferred to Nilgiris District vide proceedings dated 06.09.2025. While that being so, the third respondent passed an order of punishment of postponement of increment for a period of one year vide proceedings in Na.Ka.H.2/Tha.Pe.No.45/2025. Since the petitioner suffered certain medical ailments, he made a representation dated 17.11.2025 before the respondents, seeking to transfer him from Nilgiris to Sivagangai District. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.
4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the first respondent to consider the representation of the petitioner dated 17.11.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned counsel appearing for the respondent.
6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the first
respondent to consider the petitioner's representation dated 17.11.2025 on merits and pass appropriate orders on the same in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
