2.It is seen from the records that A.S.No.22 of 2011, filed by the petitioner and A.S.No.35 of 2011, filed by the rival party are now pending on the file of the Sub Court, Dharapuram. Therefore, the petitioner has to necessarily seek the remedy only in the pending appeal. 3.This Criminal Original Petition is disposed of by giving liberty to the petitioner to file an appropriate petition in the pending appeal and seek for protection against the rival party from interfering with the possession of the property.
