ORDER
The writ petition is filed with a prayer to permit the petitioner to remit the amount demanded by way of interest in terms of the proceedings in Composite Order Diary No.220 of 2023 vide PF Code No.TNMAS0035752000 dated 24.12.2024 in thirty equated monthly instalments.
2. It is the case of the petitioner that they have paid the contribution and that damages are now pending in appeal. As far as the interest portion is concerned, they want to remit the same in equal monthly instalments.
3. The learned counsel for the respondents would submit that the portion itself is interest and therefore instalments cannot be granted. Even the damages amount is also due.
4. I have considered the rival submissions made on either side and perused the material records of the case.
5. In similar matters, by taking equitable considerations, permission has been granted by this Court to deposit the sums in instalments. However, considering the overall amount due, the difficulty pleaded on behalf of the petitioner and the objection made by the respondents, I am of the view that the
petitioner shall be permitted to pay the interest amount demanded under the order dated 24.12.2024 in respect of PF Code No. TNMAS0035752000 by way of fifteen equal monthly instalments. The first instalment shall be from the month of March 2026 and each instalment shall be paid on or before the fifth day of every month. If the petitioner defaults in payment of even a single instalment, it shall be open to the authorities to take action to recover the entire sum.
