ORDER

The writ petition is filed for a mandamus directing the first respondent to permit the petitioner to remit the amount demanded by way of interest in terms of the Proceedings dated 24.12.2024 in 30 equated monthly instalments.

2. Upon hearing the learned counsel for the petitioner, he would submit that with reference to damages, the appeal has already been admitted. The prayer is to pay a sum of Rs.8,39,090/- towards interest in 30 equal instalments.

3. The learned counsel appearing on behalf of the respondents would oppose the prayer. She would submit that this relates only to interest and that there is no scope for granting instalments in respect of the same. She would further submit that in any event, even if any equitable relief is to be granted, the petitioner may be directed to deposit at least 50% of the sum upfront and instalments may be granted for the balance amount.

4. I have considered the rival submissions made on either side and perused the material records of the case.

5. Considering the overall facts and circumstances of the case that the

contribution has already been paid and that with reference to damages, the appeal is pending and the present prayer is only with regard to interest, the petitioner is permitted to pay the interest amount in 15 equal monthly instalments starting from the month of March 2026. Every instalment shall be paid on or before the 5th of the calendar month. If the petitioner defaults even a single instalment, it will be open to the respondents to proceed further to initiate action to recover the entire amount.
