JUDGMENT

This appeal is preferred against the order in L.A.O.P. No.03 of 2002 in reference under Section 18 of Land Acquisition Act.

2. This Court, in similar cases, has already determined compensation by fixing the market value at the rate of Rs.3.90/- per Sq.ft. The reference Court has also fixed the market value at the rate of Rs.3.90/- per Sq. ft.

3. Learned Additional Government Pleader appearing for the appellant fairly conceded that in batch of cases, the same compensation was fixed in respect of other lands in the same notification.

4. Having regard to the facts admitted, this Court is inclined to dismiss the appeal. Accordingly, this Appeal Suit is dismissed. No costs.
