specifically decide on the grievance of post-retirement medical benefits of the petitioner as already directed by Honble Bombay High Court vide its order dated 10.07.2017 in the Writ Petition in WP. 1904/2011 filed by All India UTI AMC Officers Association (of which petitioner was a member) and to direct the fourth respondent to effectively administer the trust of the welfare funds voluntary health scheme (VHS) Medical Assistance Fund (MAF) in a transparent manner, with representatives of the beneficiaries (or their representative associations) and periodically revise and communicate by way of circulars the limits of post -retirement medical claims reimbursements under these welfare funds which were created by erstwhile UTI exclusively for the benefits and welfare for employees of UTI including the petitioner. ORDER

This petition has been filed seeking a direction to the First Respondent (Union of India- Ministry of Finance) to specifically decide on the grievance of post-retirement medical benefits of the petitioner as already directed by Honble Bombay High Court vide its order dated 10.07.2017 in the Writ Petition in WP. 1904/2011 filed by All India UTI AMC Officers Association (of which petitioner was a member) and to direct the fourth respondent to effectively administer the trust of the welfare funds voluntary health scheme (VHS) Medical Assistance Fund (MAF) in a transparent manner, with representatives of the beneficiaries (or their representative associations) and periodically revise and communicate by way of circulars the limits of post -retirement medical claims reimbursements under these welfare funds which were created by erstwhile UTI exclusively for the benefits and welfare for employees of UTI

including the petitioner.

It is the case of the petitioner that the petitioner was appointed on 30.03.1992 by Unit Trust of India (UTI) a statutory Corporation which functioned under the administrative control of Ministry of Finance and the service conditions in UTI were similar to that of RBI/IDBI. The petitioner was retired on 30.06.2023 after completion of 31 years of service. Recently, the petitioner was diagnosed to suffer from Coronary Artery Disease and underwent Angioplasty producers for which cashless facility could not be availed under the Health Insurance Policy and then submitted claim for settlement of balance amount and spent almost Rs.7,00,000/- for treatment. The petitioner has also sought copy of employers health insurance policy as also clarity on reimbursement of pathological charges and other expenses which are reimbursed for a small group of retired workmen employees and denied for majority of retired officers/employees of UTI. However, the petitioner has made a representation to the respondents requesting reimbursement and the same is not considered. Hence, the present writ petition.

The party in person submitted that this Court may permit the petitioner to make application before third respondent along with all the medical documents within the stipulated time as fixed by this Court. Thereafter, this Court may direct the 4th respondent to process the reimbursement claim strictly

in terms of Voluntary Health Scheme (VHS) and UTI Medical Assistance Fund (MAF).

4. Mr.K.Seetharaman, learned counsel takes notice for the first respondent. Heard the learned counsel for the petitioner and perused the materials available on record. Since no adverse order is passed against the respondents 2 to 4, hence, notice to them is dispensed with.

Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the petitioner to made a fresh representation to the 4th respondent along with all the documents and also a copy of this order within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the said representation, the 4th respondent is directed to consider and pass orders on the petitioner's representation in terms of Voluntary Health Scheme (VHS) and UTI Medical Assistance Fund (MAF) within a period of six weeks, thereafter.

6. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
