Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order rejection in No.Rc/No.E2(1)/206/53675/2023 dated 18.11.2023 passed by the 2nd respondent in respect of issuing NOC to the petitioner and quash the same and direct the 2nd respondent to issue NOC to the petitioner's club.

O R D E R

This writ petition has been filed challenging the impugned rejection order dated 18.11.2023 passed by the 2nd respondent and for a consequential direction to the 2nd respondent to issue No Objection Certificate to enable the petitioner to run the club.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents. 3.On carefully going through the rejection order, it is seen that there is already a dispute between the owner and the tenant and the owner has given a statement to the 2nd respondent to the effect that there is no subsisting rental agreement and the signature that is found in the rental agreement that was relied upon by the petitioner is not the signature of the owner. That apart, there is also a civil dispute pending in O.S.No.6885 of 2023 for evicting the petitioner from the premises. On these grounds, the 2nd respondent has issued the rejection order.

4.This Court does not find any grounds to interfere with the rejection order passed by the 2nd respondent and this Court does not find any merits in this writ petition.

5.Accordingly, this writ petition is dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
