W.M.P.Nos.471 & 16800 of 2023 in W.P.No.29045 of 2022 N.SATHISH KUMAR.J., These miscellaneous petitions in (i) W.M.P.No.471 of 2023 has been filed by Sudalaikannu D., seeking to implead him as as party respondent and (ii) W.M.P.No.16800 of 2023 has been filed by Sivakumar B., seeking to implead him as party respondent in the main writ petition in W.P.No.29045 of 2022 which was filed by D.Sakthivel and others. The proposed respondents are petitioners in the connected writ petitions in W.P.(MD) No.9732 of 2021 and W.P.(MD) No.3941 of 2021.
2. The impleading petitioners are aggrieved by the rejection of their candidature on the ground that they had not possessed the requisite practical experience. They wanted to implead themselves as party respondents in the writ petition in W.P.No.29045 of 2022 which has been filed by some the successful candidates in the selection process for the post of Assistant Electrical Inspector seeking mandamus for issuance of appointment orders to the posts of Assistant Electrical Inspector/Assistant Engineer (Electrical) PWD/Assistant Director of Industrial Safety and Health.
3. The impleading petitioner in the respective miscellaneous petitions after being unsuccessful in the recruitment process have come up with writ https://www.mhc.tn.gov.in/judis
N.SATHISH KUMAR.J., petitions in W.P.(MD) No.9732 of 2021 and W.P.(MD) No.3949 of 2021 respectively challenging the selection process and their non-selection for the post of Assistant Electrical Inspector, Assistant Engineer (Electrical) in PWD and Assistant Director of Industrial Safety and Health.
4. The private respondents have vehemently opposed the impleading petitions. A person who is not a party has no right to be impleaded as party respondent against the wishes of the petitioner. Further, the private respondents were already impleaded as party respondents in the writ petition in W.P.(MD) No.3949 of 2021 filed by Sivakumar (petitioner in impleading petition in W.M.P.No.16800 of 2023) challenging the selection of some of the candidates. The other impleading petitioner - Sudalaikannu is concerned, he has not chosen to implead the successful candidates. The main writ petitions filed by the impleading petitioners have been dismissed today on merits.
