Prayer: Criminal Original Petition has been filed under Section 482 Cr.P.C to direct the respondents to consider the representation of the petitioner dated 22.11.2021 and to transfer the investigation of the case in Crime No.639 of 2021 on the file of the respondent No.2 to the CBCID Investigation. ORDER

The petitioner, who is the accused in Crime No.639 of 2021 for offence under Section 394 IPC, has filed this petition seeking transfer of the investigation from the file of the Inspector of Police, Cheyyar to CBCID.

2.The grievance of the petitioner is that the petitioner was illegally kept under the custody of the second respondent the Inspector of Police, Cheyyar Police Station and false case was registered against him. Hence, the petitioner made a representation to the respondents and other Authorities on 22.11.2021 and in the representation, he mentioned that the https://hcservices.ecourts.gov.in/hcservices/

petitioner was shown as accused in Crime No.615 of 2021 for offences under Section 294(b), 341, 392, 506(ii) r/w 397 IPC as though the petitioner had brandished a knife and forcibly taken. Further, another case in Moranam police station has been registered on 08.06.2020 and further, he was detained in illegal custody on 21.07.2021 to 24.07.2021 and thereafter, the case in Crime No.639 of 2021 came to be registered. Hence, sought for transfer of investigation.

3.The learned Government Advocate (Crl.side) submits that the petitioner is a habitual offender involved in several cases on similar nature. There are several cases pending against the petitioner, not only pending with the respondents and with the other police station. Now, investigation completed, charge sheet filed and the same was taken on file in C.C.No.93 of 2021 before the Judicial Magistrate, Cheyyar.

4.In view of the same, the criminal original petition is closed.
