(CRIME NO.213 OF 2020) Petition praying that in the circumstances stated therein the High Court will be pleased to relax the bail condition imposed on the petitioner in Crl.O.P.No.18777 of 2020 dated 09.12.2020 shall stay at Athur (Salem District) and report before the Athur Police Station every day at 05.30 p.m. until further orders Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.SENTHILKUMAR, Advocate for the petitioner and of M/S. S.KARTHIKEYAN, Additional Public Prosecutor on behalf of the Respondents the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.O.P No.18777 of 2020 dated 09.12.2020, that the petitioner shall stay at Athur (Salem District) and report before the Athur Police Station everyday at 5.30 p.m until further orders.
2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that charge sheet has been filed in this case and the victim girl is 6 years old and now, the case is pending for examination of witnesses. Hence, he opposed to relax the condition.
3. Considering the serious nature of the offence and age of the victim girl, this Court is not inclined to relax the condition https://hcservices.ecourts.gov.in/hcservices/
and accordingly, this Criminal Miscellaneous Petition stands dismissed. The same condition is to be continued until further orders.
