PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, pleased to issue Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 02.12.2024 and issue an online patta in favour of the petitioner for the land in new survey no. 78/10, old survey no.10/2A measuring about 1.5 cents in Thekkampatti Village, Omalur Taluk, Salem District, by virtue of the land assignment order 1244/HSD/98 dated 08.06.1989 and consequentially rectify the error in the village "A" Register, within a time frame stipulated by this Court.

ORDER

The present Writ Petition has been filed for the following relief:- To direct the respondents to consider the petitioner's representation dated 02.12.2024 and issue an online patta in favour of the petitioner for the land in new survey no. 78/10, old survey no.10/2A measuring about 1.5 cents in Thekkampatti Village, Omalur Taluk, Salem District, by virtue of the land assignment order 1244/HSD/98 dated 08.06.1989 and consequentially rectify the error in the village "A" Register, within a time frame stipulated by this Court.

2.It is the petitioner's case that he is in possession of Gramma Natham land measuring 1.5 cents in Old Survey No.10/2A in Thekkampatti Village, Omalur Taluk, Salem District for several decades. Taking note of his long possession the said lands were assigned to him by the land assignment order No.1244/HSD/98 dated 08.06.1989. The petitioner has put up a thatched shed in his property and residing thereon. During the updation of the revenue records, the old survey No.10/2A was 2/5

allotted new survey No.78/10 and the lands were classified as Government Poromboke and marked as Koothandavar Kovil Land. The petitioner had requested the respondents to rectify the entry. However, there was no response. The petitioner had given the first representation to the third respondent on 06.04.1994 and has been personally following up the same. The last representation has been given on 02.12.2024. Since there is no progress the petitioner has moved this Court. 3.Heard the learned counsels on either side and perused the records. Mr.A.Selvendran, the learned Special Government Pleader takes notice on behalf of respondents 1 to 3.

4.Considering the request of the petitioner and taking note of the fact that from the year 1994 his grievance has not been redressed by the Revenue Authorities, the Writ Petition is allowed and a mandamus is issued to consider and pass orders on the petitioner's representation dated 02.12.2024 within a period of five months from the date of receipt of copy of this order. It is needless to stated that the respondents shall give a personal hearing to the petitioner before orders are pronounced. 3/5

5.Accordingly, the Writ Petition is allowed with the above directions. No costs.
