Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to release the security amount to the petitioner on considering the representation sent by the petitioner dated 11.11.2017.

ORDER

The petitioner seeks a direction to the respondent to release the security amount to him on considering his representation dated 11.11.2017.

Learned Counsel for the petitioner submitted that on the basis of the notification dated 10.01.2009 issued by the respondent calling for tender for strengthening the Village Road in Thalaivasal Union, the petitioner applied for the same and by Notification dated 24.02.2009, the respondent handed over the said project to him for commencing the tender work. Thereafter, he completed the said project and handed over the same to the respondent to their fullest satisfaction. But, unfortunately, the respondent refused to release the security deposit. Hence, the petitioner has given a representation dated 11.11.2017 to release the security deposit. But no action has been taken on the same so far. Hence the present Writ Petition. 3.

Learned Special Government Pleader who takes notice on behalf of the respondent sought time to take an instruction as to whether the petitioner has completed the work successfully https://hcservices.ecourts.gov.in/hcservices/

and he is entitled for release of security deposit as alleged by him.

However, considering the facts and circumstances of the matter, instead of taking instruction and report the same to this Court, this Court directs the respondent to consider the pending representation of the petitioner dated 11.1.2017 and pass appropriate orders, on merits and in accordance with law for releasing the security deposit, within a period of two weeks from the date of receipt of a copy of this Order. 5.

The Writ Petition is disposed of accordingly. No costs.
