Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under sections 379, 430 of I.P.C r/w. Sec.36(A) of Mines and Minerals Act, in Crime No.185 of 2021 seeks anticipatory bail.
2.The case of the prosecution is that the petitioners along with other accused illegally transported three units of river sand without any permission from the concerned authority. Hence, the Law Enforcing Agency registered a case against the petitioners. 3.The learned counsel appearing for the petitioner submits that the petitioners are no way connected with the occurrence as alleged by the prosecution and they have been falsely implicated in this case. 4.The learned Government Advocate (Crl.Side) submits that there are five previous cases pending against the petitioners. Hence, he vehemently opposed grant of anticipatory bail to the petitioners . 5.Considering the previous cases pending against the petitioners and further if the petitioners were granted anticipatory bail, they may get absconded and in such circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 10/01/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
