ORDER

The petitioners, apprehend arrest at the hands of the respondent police for alleged offences punishable under Section 303(2) of BNS in Crime No.248 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The allegation against the petitioners is that, the petitioners herein have committed theft of copper coil and insulating oil belonging to TNEB Venkattampettai, worth about Rs.4,00,000/-. Hence the case has been registered.

3. The learned counsel for the petitioners submitted that the petitioners are the innocent persons and have been falsely implicated in this case. It is also submitted that the petitioners are ready to abide by any condition that may be imposed by this Court. Hence, she prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate appearing for the respondent police reiterated the prosecution case and submitted that the petitioners herein are ranked as A3 to A5 and that A1 and A2 have already been arrested and that the investigation in this case is pending. Further, she submitted that the petitioners have sold the stolen property and shared the money among themselves. Hence, she vehemently opposed the grant of anticipatory bail to the petitioners.

Considering the nature of the allegation, and the fact that a huge value of property has been stolen and that, so far, the stolen property has not been recovered, and also taking into account that the first petitioner is having three previous cases, the second petitioner is having four previous cases and the third petitioner is having three previous cases, this Court is not inclined to grant anticipatory bail to the petitioners.
