ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 26.07.2021 for the offences under Sections 302, 201 of IPC altered into 498A, 302 and 201 of IPC, in Crime No.1022 of 2019, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on the date of occurrence, the petitioner/A1 along with another entered into the deceased house and murdered the deceased by using iron rod and snatched her jewels and further alleged that the petitioner sold her jewels and also spend the amount.Hence, the complaint.
3.The learned counsel for the petitioner submits that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration for more than 163 days from 26.07.2021 and hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner already involved in many robberies and murder cases. He further submits that the investigation was completed and charge sheet also filed by the respondent police in https://hcservices.ecourts.gov.in/hcservices/
S.C.No.146 of 2021 and if the petitioner released on bail, he shall tamper with evidence or witness during trial. 5.Considering the facts and circumstances of the case and the submissions made by both counsel and also considering the gravity of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
