O R D E R

This writ petition has been filed for issuance of writ of mandamus directing the respondents 1 to 3 to consider the representation made by the petitioner on 27.12.2022 and to take action against the 4th respondent.

2. Heard Mr.K.Jayakumar, learned counsel for the petitioner and Mrs.V.Yamunadevi, learned Special Government Pleader appearing for the respondent 1 to 3.

3. The grievance of the petitioner is that the 4th respondent, who is her husband, has left her and two female children in lurch. In spite of maintenance order passed, the 4th respondent is not paying any maintenance and he had also made a false declaration regarding his salary. The 4th respondent is also not complying with the order passed by the competent Court in the restitution of conjugal rights petition. It is under these circumstances, a representation was made 2/4

by the petitioner on 27.12.2022, for taking action against the 4th respondent. Since the same was not considered, the present petition has been filed.

4. Taking into consideration the facts and circumstances of the case and the limited relief sought in this writ petition and without going into the merits of the case, there shall be a direction to the respondents 2 and 3 to deal with the representation made by the petitioner on 27.12.2022 on its own merits and in accordance with law and take a decision, within a period of eight weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the respondents 2 and 3 along with all relevant documents and also a copy of this order. Before taking any decision, the 4th respondent shall be put on notice and he shall also be called during enquiry. The writ petition is disposed of with the above direction.
