The appeal suit was listed for hearing on 04.12.2019. None appeared for the petitioner. Thus, the appeal suit was directed to be listed "for dismissal" on 05.12.2019. When the matter is listed on 05.12.2019, there was no representation on behalf of the appellant. Inspite of the fact that two opportunities were given to the appellant, there was no representation.

2. Even on earlier occasion, when the matter was listed, the drafted notice was sent to the appellant by the Registry and the said notice was also acknowledged by the appellant. Thus, several opportunities were granted and the appellant is not interested in pursuing the appeal. Therefore, the first appeal is dismissed for non-prosecution. No costs.
