ORDER
The writ petition is filed seeking writ of mandamus to direct the respondents 1 and 2, by considering the representation of the petitioners dated 07.04.2022, seeking for payment of enhanced compensation to the entire extent of 0.49.5 Hectare as determined by the 2nd respondent in his award of redetermination of compensation dated 05.08.2016 passed in Award No. 57/2016, instead of an extent of 9985.99 Sq.St. pertaining to the petitioners' land situated at Siluvampatti Village, Namakkal Taluk and District, comprised in S.No. 350/2 and to pass such further or other orders.
2.
The learned Counsel for the petitioners would submit that the petitioners are the absolute owners of the subject land comprised in S.No.350/2, measuring 0.49.5 Hectare and other adjacent lands situated at Siluvampatti Village. While so, the subject land was acquired by the 2nd respondent in the year 1999, for the purpose of constructing the Master Plan Complex and the 2nd respondent had passed an Award fixing the marking value of the land as Rs.61,728/- per hectare. Thereafter, the 2nd respondent has passed an award of re-determination of compensation in respect of the subject property on
05.08.2016 in Award No.57 of 2016, enhancing the amount of compensation pertaining to the subject land at the rate of Rs.26 per Sq.ft as prayed for by the petitioners and the 3rd respondent. However, while passing award, the extent of the land to be acquired has been wrongly stated as 9985.99 sq.ft instead of 53,256 sq.ft. Aggrieved by the same, the petitioners and the 3rd respondent have jointly submitted their representation to respondents 1 and 2 dated 07.04.2022, seeking for payment of enhanced compensation to the entire extent of 0.49.5 Hectare as determined by the 2nd respondent in his award of redetermination of compensation dated 05.08.2016 instead of an extent of 9985.99 sq.ft. However, the said representation was kept pending till date. Hence the petition.
3.
The learned Additional Government Pleader appearing for respondents 1 and 2 would submit that petitioners' representation would be considered within a time frame that may be stipulated by this Court, which was agreed to by learned counsel for petitioners'. 4.
Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the appropriate authority to dispose of the petitioners' representation dated 07.04.2022, on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.
With the aforesaid direction, this writ petition stands disposed of. No costs.
