This Civil Miscellaneous Petition is filed to set aside the order of dismissal dated 09.01.2012 and restore the M.P.No.2 of 2013 in the above appeal suit.

2. Heard Ms.V.V.Sathya, learned counsel for petitioner.

3. In view of the reasons stated in the accompanying affidavit filed in support of the miscellaneous petition, this Court is inclined to restore the M.P.No. 2 of 2013.

Accordingly, this petition stands allowed.
