JUDGMENT

The appeal suit has been filed to set aside the decree passed in L.A.O.P.No.358 of 1992 dated 21.04.2004 in the Court of the First Additional Subordinate Judge of Coimbatore.

2. The learned Government Advocate appearing for the appellant, on instructions, would submit that the entire award amount had been deposited before the Executing Court and recording the same, the Execution Petition filed in respect of the award had also been closed. In view of the same, no further adjudication is required to be made in the appeal suit as sanction has also been accorded to withdraw the appeal suit.

3. Recording the same, the appeal suit stands dismissed as withdrawn. No costs. Consequently, connected miscellaneous petitions are closed. 23-03-2026 Index: Yes/No Speaking/Non-speaking order kak
