PRAYER: Criminal Revision Petition is filed under Sections 438 r/w 442 of BNSS, to call for the records pertaining to the order passed by the learned Additional District Judge/Presiding Officer, Special Court for EC Act Cases, Coimbatore in Crl.M.P.No.639 of 2025 dated 09.04.2025 and consequently modify the condition No.7(4).

ORDER

The Revision challenges the condition imposed on the petitioner, while directing the return of his property, pending disposal of the trial. 1/4

2.It is the case of the respondent that the petitioner's vehicle was used by the accused for commission of the offence under the NDPS Act. The petitioner is not an accused in the case. The petitioner sought for return of the vehicle, which was returned to him inter alia on the following condition; "4.The petitioner shall produce the above said vehicle before this court on the first working day of every month without fail until further orders"

3.The learned counsel for the petitioner would submit that since the petitioner is a permanent resident of Kerala, he is unable to produce the vehicle before the trial Court every month.

4.The learned Government Advocate (Crl. Side) would submit that the petitioner has been complying with the above condition so far. 5.Considering the fact that the petitioner is a resident of Kerala, the above condition is modified, by directing the petitioner to produce the vehicle before the trial Court, once in two months. 2/4

6.Accordingly, the Revision is allowed.
