O R D E R
(The case has been heard through video conference) This Writ Petition has been filed seeking a direction directing the 2nd respondent to dispose the appeal filed by the petitioner under Section 10 of Patta Passbook Act.
2. The grievance of the petitioner is that against the order passed by the Tahsildar cancelling the patta, the petitioner has preferred the appeal before the 2nd respondent on 25.09.2020, but so far, the appeal was not disposed of. Hence, the present Writ Petition has been filed by the petitioner.
3. I have heard and considered the submissions made by learned counsel appearing for petitioner as well as learned Addl. Government Pleader and perused the records carefully.
4. Considering the limited prayer sought in the Writ Petition, without going into the merits of the case, the 2nd respondent is directed to consider the petitioner's appeal and to pass suitable orders on merits after giving opportunity to the petitioner as well as to the rival claimants within a period of four weeks from the date of receipt of copy of this order. Accordingly, this Writ Petition stands disposed of. No costs. Sd/- Assistant Registrar(CS VII) //True Copy// Sub Assistant Registrar rpp To
