Crl.O.P.No.653 of 2024 C.V.KARTHIKEYAN, J.

The petitioner, who was arrested and remanded to judicial custody on 08.06.2023 for the offences punishable under Sections 376(2)(n), 506(i), 506(ii), 450, 376(3) and 354(D)(1)(i) of IPC r/w Section 5(1), 6(1), 11(4) and 12 of POCSO Act in Crime No.08 of 2023, seeks bail.

2.The case of the prosecution is that the petitioner had trespassed into the victim child house and had committed sexual assault against the victim child. Hence the complaint. 3.It is stated that the petitioner herein is a married person and the victim child is a minor aged 15 years. It is also stated that, after investigation, final report had been filed and it is now pending trial in S.C.No.72 of 2023 before the learned Special Judge For Exclusive Trial of Cases Under POCSO Act, Tiruvannamalai.

4.An earlier petition seeking bail was dismissed on 10.11.2023 in Crl.O.P.No.25777 of 2023. Subsequently, the Court had also examined PW-1 to PW-5.

smv 5.The learned counsel for the petitioner stated that the witnesses had been declared hostile.

6.A direction is given to the learned Special Judge, Special Court For Trial of Cases Under POCSO Act, Thiruvannamalai, to conclude the trial on or before 09.02.2024 by taking up the case on a day to day basis. Since that direction is given, this Criminal Original Petition seeking bail stands dismissed.
