ORDER

This Criminal Original Petition has been filed praying to direct the second respondent to register a case based on the petitioner complaint dated 01.04.2016 in CSR No.88 of 2016 and investigate this same in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that petition enquiry is pending in C.S.R.No.88 of 2016. Considering the submissions made by the learned counsel on either side, the second respondent is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari V. https://hcservices.ecourts.gov.in/hcservices/

Government of Uttapradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

4. With the above direction, this Criminal Original Petition is closed.
