The petitioner/A3, who was arrested and remanded to judicial custody on 02.07.2023, registered for the offences under Sections 8(c) r/w 20(b) (ii)(c), 29(1) of NDPS Act in Crime No.275 of 2023 on the file of the respondent Police, seeks bail.

2. It is the case of the prosecution that the petitioner along with other accused were in possession of 20.500 kgs of Chars and 400 ml of Hashish Oil, which is commercial quantity.

3. The learned Government Advocate ( Criminal Side) stated that the quantity of contraband involved in this case is commercial in nature. He further submitted that A1 belongs to Bihar and A2 belongs to Nepal. Hence, if the petitioner/A3 released on bail there is a possibility of absconding to Nepal.

4. In view of the above, I am not inclined to grant anticipatory bail to the petitioner herein. Accordingly, this Criminal Original petition stands dismissed.
