J U D G M E N T
The Appeal Suit was listed for hearing on 03.12.2019 and none appeared for the appellant. Thus, the case was listed under the caption 'For Dismissal' on 04.12.2019. Again, when the matter was called on 04.12.2019, there was no appearance on behalf of the appellant. Thus, in order to give a further opportunity, the appeal is directed to be listed under 1/2 https://hcservices.ecourts.gov.in/hcservices/
the same caption 'For Dismissal' on 05.12.2019. When the case is taken up for hearing today, no one appeared on behalf of the appellant. In spite of the opportunities given twice, the appellant is not interested in pursuing the appeal suit.
2. Thus, the First Appeal in A.S.No.599 of 2010 stands dismissed for non-prosecution. However, there shall be no order as to costs.
