J U D G M E N T

This Civil Miscellaneous Appeal has been filed by the claimant against the judgment and decree dated 15.02.2005 made in M.C.O.P.No.120 of 2004 on the file of the Motor Accident Claims Tribunal (Fast Track Court) at Kallakurichi.

2.Today, when the matter was taken up for hearing, learned counsel appearing for the first respondent submitted that the appellant had already approached the Deputy Commissioner of Labour under Workmen's Compensation Act at Kallakurichi, in W.C.No.340 of 1998, for appropriate relief. The said fact was conceded by the learned counsel for the appellant.

3.Recording the submission made by the learned counsel on either side, this Civil Miscellaneous Appeal is closed with liberty to the appellant to proceed with the matter before the said forum in accordance with law. No costs.
