ORDER

Seeking a direction to the 2nd respondent to register an FIR on the petitioners' complaint dated 23.07.2014 and investigate the same in accordance with law, the petitioner has come up with this petition.

2. It appears that there are four petitioners before this Court and they were inducted as tenants by one Prema, after receiving a sum of Rs.32 lakhs from them. Thereafter, when they wanted to vacate, the said Prema was eluding and not repaid the amount. When they were approached the said Prema, she stated that https://hcservices.ecourts.gov.in/hcservices/

she is not the owner and one Abdul Naser is the owner. Hence, the petitioners lodged a complaint before the respondent police and during the enquiry, the said Abdul Naser came to the police station and stated that he is the owner and he will take up the issue with the tenants. Thereafter, Abdul Naser also absconded and left the petitioners in the lurch. Now it is stated that some other persons are stating that they are the owner of the property.

3. The learned Additional Public Prosecutor submits that the complaint given by the petitioners was enquired and closed on 01.08.2013.

4. This Court finds that enquiry has been conducted very perfunctorily by the respondent police and therefore, the petitioners are directed to give a complaint individually to the Assistant Commissioner of Police, Neelankarai and on receipt of the same, the Assistant Commissioner of Police shall enquire into the complaints and take action in order to find out a truth.

5. This Criminal Original Petition is disposed of with the above direction.
