This Criminal Original Petition has been filed for a direction to the the Principal Sessions Judge, Chennai, to consider the bail application of the petitioner on the same day after the petitioner's surrender in Spl.S.C.No.163 of 2023 in connection with Crime No.1 of 2022 on the file of respondent police.

2. Heard Mr.O.Ravi, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor, appearing for respondents.

When the matter was taken up for hearing, learned Additional Public Prosecutor, on instructions, submitted that investigation was completed and charge sheet was filed before the Special Court, Chennai and the same was taken on file in Spl.S.C.No.163 of 2023. Learned Additional Public Prosecutor further submitted that summons were served on the petitioner through e-mail. Since the petitioner did not appear, a non-bailable warrant is pending.

4. Learned counsel for petitioner submitted that the petitioner is presently in South Korea and that he will surrender before the Court on 18.01.2024 and file an application for recalling the non-bailable warrant.

5. Considering the facts and circumstances of the case and also considering the fact that investigation has already been completed, it is left open to the petitioner to file a petition for recalling the non-bailable warrant before the Special Court on 18.01.2024 and the Special Judge shall deal with the same and pass orders on the same day.
