2. This Court by order dated 20.11.2020, directed the Registry to issue notice to the appellants returnable by 10.12.2020 as the counsel appearing for the appellants reported no instructions from the appellants. Pursuant to the order directing notice to the appellants, it appears that attempt has been made to serve notice on the appellants. Though the appellants 1,2 & 4 were available, they refused to receive notice. This Court is of the view that the appellants are adopting delaying tactics. It is not necessary for this Court to wait for the appellants, but can proceed on the basis of the earlier representation of the learned counsel for the appellants.
The Appeal Suit is dismissed for non prosecution. No costs. Sd/- Assistant Registrar(CS IX) //True Copy// Sub Assistant Registrar To The VI Additional Judge, City Civil Court, Chennai.
