The Second Appeal is filed under Section 100 of CPC against the judgment and decree dated 30.03.1999 in A.S.No.88 of 1996 on the file of the Additional District Judge, Villupuram modifying the judgment and decree dated 29.06.1996 in O.S.No.1126 of 1988 on the file of the Additional District Munsif, Villupuram. JUDGMENT
The second appeal is directed as against the judgment and decree dated 30.03.1999 in A.S.No.88 of 1996 on the file of the Additional District Judge, Villupuram modifying the judgment and decree dated 29.06.1996 in O.S.No.1126 of 1988 on the file of the Additional District Munsif, Villupuram.
2. The learned counsel for the first respondent submitted that the respondents 1,4,5,7 and 8 died. The learned counsel for the appellant also submitted that the sole appellant died long back and they could not get instruction from the legal heirs of the sole appellant.
3. It is seen that though the sole appellant died long back, the legal heirs of the sole appellant have not taken any step to implead themselves as party to the second appeal, which shows that they have no interest to proceed with the second appeal. Therefore, the second appeal is liable to be dismissed as abated. Further, it is also seen that the sole objector also died, however the legal heirs have not taken any step to implead themselves as party. Therefore, the cross objection petition is also liable to be dismissed.
4. Accordingly, the second appeal is dismissed as abated, and the cross objection petition in Cros.Obj.No.149 of 2010 is also dismissed as abated. Consequently, connected miscellaneous petitions are closed. No costs.
