This writ petition has been filed to quash the auction sale dated 8/1/2025 via auction No.MSTC/SRO/O/o the Commissioner of Central Tax & Central Excise/2/Race Course Road/24-25/43605 (474881).
2. When the matter is taken up for hearing, learned counsel appearing 2/4
for the respondents 2 and 3 by referring to paragraph No.9 of the counter affidavit, submitted that they have not proceeded with the auction sale which was conducted on 8/1/2025, since there were no takers. Hence the respondents are proposing to conduct fresh auction and the same could not be done due to the pendency of this writ petition.
3. In such a view of the matter, this writ petition is dismissed as infructuous, as nothing survives for further adjudication. No costs. Consequently, connected Miscellaneous Petitions are closed. 12/2/2025 Index : Yes / No mvs.
