Learned counsel for the petitioner submitted that the petitioner, who faced trial in S.T.C.No.253 of 2021, was convicted and sentenced to
undergo 18 months simple imprisonment and to pay a compensation of Rs.20,00,000/- to the complainant within one month, in default, to undergo a further period of two months simple imprisonment. Challenging the same, she filed appeal in Crl.A.No.244 of 2025 on the file of the learned Principal District and Sessions Judge, Tiruvallur. Pending appeal, the petitioner filed a petition in Crl.M.P.No.1/2025 in Crl.A.No. 244/2025 seeking suspension of sentence and the same was allowed by order dated 10.11.2025 directing her to deposit 20% of the compensation amount before the trial Court to the credit of S.T.C.No.253 of 2021 within a period of sixty days and also directing her to appear before the learned II Additional District and Sessions Judge, Poonamallee on 09.01.2026. However, the petitioner was unable to comply with the said condition as she was unable to mobilize the fund within the stipulated time, which is neither willful nor wanton.
