Crl.M.P.No.326 of 2024 in Crl.A.SR.No.61140 of 2023 M. NIRMAL KUMAR , J This petition is filed to condone the delay of 4 days in filing the above appeal.

2.Heard the learned Counsel for petitioner.

3.Mr.Abdul Sageer.P.P., learned counsel appearing for the respondent submits that the petition can be allowed subject to some cost.

4.The learned counsel for petitioner submits that the petitioner has got a right to file an appeal but due to his old age and whereabouts at Kerala, he is unable to reach Chennai within time to instruct his counsel.

For that reason the delay has occurred.

5.Finding that the reasons given by the petitioner is acceptable, this Court condons the delay and the petition is ordered.
