Respondent/Petitioner Appeal preferred under Clause XV of Letters Patent against the order dated 18.08.2008 made in W.P.No.18782 of 2008. The Writ Petition is filed under Article 226 of constitution of India, praying for the issuance of a writ of certiorified mandamus, calling for the records pertaining to the order passed by the 1st respondent in his proceedings O.Mu.No.4951/Aa4/2007 dated 4.2.2008 confirming the order passed by the 2nd respondent in this proceedings O.Mu.No.2186/AA1/2007 dated 22.10.2007 and quash the same and direct the respondents to sanction one set of incentive increment to the petitioner for M.Ed. qualification and confer all the consequential benefits.

JUDGMENT

(Judgment of the Court was delivered by M.M.SUNDRESH, J.) This writ appeal is directed against the order dated 18.08.2008 made in W.P.No.18782 of 2008, whereby the learned single Judge directed the first appellant to sanction incentive increment for M.Ed. Degree.

2.Heard the learned Government Advocate appearing for the appellants and the learned counsel appearing for the respondent. 3.We are not inclined to go into the legal issue raised particularly in view of the fact that the third incentive increment has already been paid in favour of the respondent and he has already reached the age of superannuation. 4.In such view of the matter, the writ appeal stands dismissed. No costs. Consequently connected miscellaneous petition is closed.
