Criminal Revision filed under Section 397 r/w.401 of Criminal Procedure Code, praying to set aside the judgment dated 4.12.2018 passed by the Second Additional Sessions Judge, Puducherry in Criminal Appeal No.47 of 2017 confirming the judgment dated 22.11.2017 passed in STC.No.316 of 2016 by the Judicial Magistrate, Mahe, Puducherry.

O R D E R

This revision arises out of a judgment convicting and sentencing the revision petitioners for the offence under Section 138 of Negotiable Instruments Act. Since both sides arrived at a compromise, petition in Crl.M.P.No.1800 of 2022 has been filed seeking to compound the offence. https://hcservices.ecourts.gov.in/hcservices/

2. Both sides learned counsel appeared before this court and the respective parties who also appeared in virtual mode are identified by their respective counsels and both sides agreed that the matter has been compromised and the offence is to be compounded.

3. Accordingly, this court records the compromise. The offence is now compounded and the revision petitioners are discharged of the accusations in the case. It is also agreed between the parties that a sum of Rs.12,12,000/- already deposited by the 2nd Revision petitioner before the trial court, pursuant to the order of this court dated 09.01.2019 passed in Crl.M.P.No.370 of 2019 in Crl.R.C.No.44 of 2019 has to be withdrawn by the 2nd Revision Petitioner. The Revision Petitioners are now at liberty to move the trial court for withdrawing the said sum. This criminal revision case is disposed of accordingly. Consequently, connected miscellaneous petition is closed.
