Crl.M.P.Nos.484, 483 and 486 of 2022 in Crl.R.C.Nos.822 to 824 of 2022 A.D.JAGADISH CHANDIRA, J.

One M/s.Jenith Herbals of Kolli Hills, Namakkal District and its Agents in the nearby locality stand charged with the offence under Section 120(B), 420, 406, 107 IPC and section 5 of TNPID Act on the allegation that they had induced the villagers of that locality that they could earn quick and huge amount by depositing their hard earned money in the said Company and cheated them and thereby three Calendar Cases viz., C.C.Nos.34 to 36 of 2013 on the file of the Special Judge under TNPID Act, Coimbatore have been filed at the instance of three de facto complainants viz., (1) G.Natarajan; (2) Mohan; and (3) M.Palanisamy respectively.

It appears that the accused persons in those Calendar Cases had filed separate Criminal Miscellaneous Petitions before the Trial Court seeking for a single trial and the Trial Court had dismissed the same. Aggrieved against the same, one of the accused viz., C.Sundaram, who figures with different ranking in those Calendar Cases, alone had filed the above Criminal Revision Cases.

3. Now, the present Miscellaneous Petitions have been filed for impleading the other accused persons in the Criminal Revision Cases.

4. Learned counsel for the petitioners would submit that due to paucity of time, one of the accused by name C.Sundaram alone had filed the Criminal Revision Cases challenging the order passed by the Trial Court refusing to order for single trial. He would further submit that the other accused persons barring one in all the three cases have filed their affidavits giving consent for single trial and only in order to avoid multiplicity of proceedings and to avoid filing of separate Criminal Revision Cases, the Miscellaneous Petitions have been filed seeking impleadment of the other accused persons in the present Criminal Revision Cases. He would also submit that though some of the accused persons had not asked for single trial, they also have no objection for conducting single trial and they have also joined in the impleading application.

5. Learned Government Advocate (Criminal Side) has no objection for the petitions being ordered.

6. In view of the facts and circumstances of the case, the Criminal Miscellaneous Petitions seeking impleadment are ordered. 20.1.2021.
