Prayer in W.P.No.525 of 2020:- Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents to refund 2.5% and 5% of the Guaranteed amount to the petitioner for the work carried out by him in North Division in Udahagamnadal, Nilgiri District from 1998 to 2011 with 18% interest for the delayed payment.

Prayer in W.P.No.2560 of 2020:- Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents to refund 2.5% and 5% of the Guaranteed amount to the petitioner for the work carried out by him in South Division in Udahagamnadal, Nilgiri District from 1996 to 2012 with 18% interest for the delayed payment.

C O M M O N O R D E R The above Writ Petitions are filed to direct the respondents to refund 2.5% and 5% of the Guaranteed amount to the petitioner for the construction work carried out by him in North and South Division in Udahagamandalam, Nilgiri District from 1996 to 2012 with 18% interest for the delayed payment.

2. The learned Government Advocate has produced a communication from District Forest Officer, Nilgiri addressed to Principal Chief Conservator of Forest, e/f/vz;/7667-2020 f ehs;/16/02/2023 stating that a sum of Rs.43,82,160/- has to be paid towards the guarantee fund.

3. In view of the above, nothing survives in these Writ Petitions and the same stand dismissed. However, it is made clear that the said amount shall be disbursed to the respective petitioners, within a period of four weeks from the date of receipt of a copy of this order. With regard to interest, the same shall be as per law. No costs. 09.03.2023 nvi Index:Yes/No 3/5
