Respondents Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent Inspector of Police H-1, Washermenpet Police Station, Chennai District to provide adequate Police protection to the petitioner and his family members based on the complaint, dated 29.07.2022.

ORDER

This petition has been filed for a direction to the respondent Police to give Police protection to the petitioner and his family members based on the complaint dated 29.07.2022.

2. Heard Mr.S.Suresh, learned Counsel for the petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor for the first respondent.

3. It is seen from the records that already the second respondent along with others had trespassed into the property and had attacked the petitioner resulting in registration of an F.I.R in Crime No.497 of 2019 before the first respondent Police. According to the petitioner, the second respondent was repeatedly causing threat and hence a representation / complaint was given to the first respondent on 29.07.2022. Since the same did not evoke any response, the present petition has been filed before this Court.

4. The learned Additional Public Prosecutor on instructions submitted that based on the complaint given by the petitioner, an enquiry was 2/4

conducted by the first respondent and on 29.05.2022, the second respondent gave an undertaking that he will not interfere or cause threat to the petitioner. Based on the said undertaking, the complaint was closed.

5. Taking into consideration the submission made by the learned Additional Public Prosecutor, it is made clear that if the second respondent and persons claiming under him cause any more threat or interfere with the possession and enjoyment of the property of the petitioner, necessary action shall be taken against them.

6. This Criminal Original Petition is disposed off with the above direction.
