PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to direct the 2nd respondent police to provide police protection to the petitioner.

ORDER

This Criminal Original Petition has been filed seeking for a direction to direct the 2nd respondent police to provide police protection to the petitioner.

2. The learned Additional Public Prosecutor on instructions submitted that there is a pending dispute between the petitioner and the 3rd respondent. It is stated that the private respondents had put up some construction and thereby, obstructing the pathway which is used by the petitioner as an access. The same resulted in two earlier complaints given against the private respondents and others which has been registered in Crime Nos.395 of 2023 and 584 of 2023 on 19.08.2023 and 04.12.2023, respectively by the 2nd respondent police. Even during the pendency of the investigation in these two FIRs, once again threat 2/4

has been exerted against the petitioner. It is also seen that this issue has already been dealt with by the District Revenue Officer through proceedings dated 20.10.2023. By virtue of this proceeding, the District Revenue Officer has also issued certain directions.

3.In the light of the above development, there shall be a direction to the 2nd respondent to act upon the complaint given by the petitioner dated 22.12.2023 by calling the parties for enquiry. The 2nd respondent shall strictly go by the earlier orders passed by the revenue officials and take a decision with regard to providing police protection, within a period of two weeks from the date of receipt of copy of this order. It is also made clear that the pending investigation shall be expedited.
