(Order of the Court was made by A.SELVAM,J.) This petition has been filed praying to direct the Superintendent of Special Prison for Women, Vellore, to grant parole or emergency release for a period of five days to Mageswari, who has been detained as 'Bootlegger' by virtue of Act 14 of 1982.

2. It is averred in the petition that the petitioner is a son of sister of the detenue. The detenue has been detained as 'bootlegger' under Act 14 of 1982, in Special Prison for Women, Vellore. Further, it is averred in the petition that the sister of the detenue, by name, Indira, has passed away on 22.09.2016 and for the purpose of attending condolence, the present petition has been filed for getting the relief sought therein.

3. The learned counsel appearing for the petitioner has reiterated the averments made in the petition.

4. The learned Additional Public Prosecutor has confirmed the death of sister of the detenue.

5. Considering the aforesaid factual circumstances, this Court is of the view to grant the relief sought in the petition, subject to the following conditions:

In fine, this petition is allowed. The detenue is directed to execute a bond to the tune of Rs.5000/- (Rupees five thousand only) with two sureties, each for a like sum, to the satisfaction of the Superintendent of Special Prison for Women, Vellore. After getting sureties, the Superintendent of Special Prison for Women, Vellore, is directed to pass necessary order with regard to grant of parole for a period of five days, from 23.09.2016 to 27.09.2016. The Superintendent of Special Prison for Women, Vellore, is also directed to provide necessary escort, at the cost of the detenue. (A.S.J.) (P.K.J.) 23.09.2016 msk Note to Office:
