O R D E R
The present application has been instituted to direct the respondent to provide documents with regard to the title deed of the Trust respect to the land admeasuring to an extent of 0.99 cents, comprised in S.No.87/2 of Ayanambakkam Village.
2. Learned counsel for the applicant would mainly contend that respondent has no document to establish that they are empowered
to administer the Trust property. Therefore, the applicant has filed an application to furnish a copy of Title Deed. Since no action has been taken, the present Application has been filed.
3. The fact remains that there are about 150 estates under administration of AG & OT. Will of the Testator is of paramount importance in administration of Trust Estates. C.Kandasamy Naidu is one of the Trust under administration by AGandOT. and Trust Estate of C.Kandasamy Naidu was vested with the Office of AGandOT as per last Will of C.Kandasamy Naidu dated 21.05.1948 and as per letters of administration of this Court in O.P.No.278/1948 dated 05.10.1948. Earlier an application was filed by Applicant in A.No.2303 of 2025 and this Court passed order on 29.04.2025. Paragraph No.5 of the order reads as under:
"5. In such circumstances, this Court is of the view that these applications claiming title or consequential reliefs on the basis of title cannot be decided unless the facts or records are admitted. Since question of title has been raised for the first time, this Court doubts the bona fides of the applicants. Hence, without prejudice to the rights of the Trust and the applicants, this Court dismisses these applications with liberty to the applicants to approach the Civil Court to establish their title in the manner known to law."
4. This Court already relegated the Applicant to approach the competent Civil Court for establishing her title. In the absence of any title
or vested right over the subject property, filing application before this Court is not maintainable.
